Diablo Canyon: Boxer will seek answers on earthquake risks in Senate hearing | F.O.E. News releases

WASHINGTON, D.C. – On Wednesday, December 3, Nuclear Regulatory Commissioners will face tough questions from Sen. Barbara Boxer (D-Calif.) over the NRC’s suppression and rejection of a report that cited dangers at Diablo Canyon nuclear power plant. The report, by Diablo Canyon’s former chief inspector Michael Peck, warned that the plant may not be safe from earthquakes.

Sen. Boxer, chair of the Environment & Public Works Committee, called the hearing after revelations surfaced in August that Peck had filed a formal dissent over inaction by the NRC on startling new seismic information. The dissent detailed how the discovery of new faults, unknown when the plant was designed and built more than 40 years ago, casts doubt on whether the plant can withstand shaking from newly identified earthquake faults surrounding the 1960s-era nuclear reactors on California’s Central Coast.

The NRC kept Peck’s dissent secret for more than a year before denying it in September. Expert testimony will also address the seismic report released by PG&E on the same day as the NRC decision, which revealed that faults surrounding Diablo are far larger and interconnected and therefore capable of stronger shaking than the plant was designed to withstand.

WASHINGTON, D.C. – Friends of the Earth has petitioned the U.S. Court of Appeals to overturn a secret decision by the Nuclear Regulatory Commission to illegally alter the operating license for the Diablo Canyon nuclear power plant allowing Pacific Gas and Electric to hide the fact that the reactors are vulnerable to earthquakes stronger than it was meant to withstand.

The secret revision of Diablo Canyon’s license was revealed in NRC documents rejecting a dissent by the plant’s former senior resident inspector. The inspector, Dr. Michael Peck, defied his superiors in saying that Diablo Canyon was operating in violation of its license and should be shut down unless and until new seismic information was addressed.

In a July 2013 formal dissent, which the NRC suppressed for more than a year, Dr. Peck argued that newly discovered faults could produce earthquakes far more destructive than the plant was designed, built and licensed to withstand. Last month, in rejecting the dissent, the NRC revealed that in September 2013 it had changed the way the risk of earthquakes at the plant are assessed -- in effect, rewriting history and science to make the threat of more powerful earthquakes go away, without requiring any safety upgrades by PG&E.

The amendment was added in secret, unknown beyond the highest levels of PG&E and the NRC. Today Friends of the Earth petitioned the U.S. Court of Appeals for the D.C. circuit to review the amendment, overturn it and order a public license amendment proceeding as required by federal law.

“PG&E’s new seismic study reveals that the earthquake threat at Diablo -- if measured by its original license -- could be far greater than that for which the reactors were designed.  So PG&E and the NRC secretly amended the license to relax the safety requirements,” said David Freeman, former head of the Tennessee Valley Authority, Los Angeles Department of Water and Power and the Sacramento Municipal Utility District. “This is not only illegal, it’s an outrage.”

PG&E has enough trouble on its hands from the San Bruno explosion, where they had also claimed they had put safety first,” said Freeman,  senior advisor to Friends of the Earth. “This secret action shows they don’t put safety first.  Thank goodness there are courts in America that can give us an independent decision.”

Under federal law and NRC regulations, changing the way seismic risk or reactor durability is assessed requires a public license amendment review. Instead, in consultation with PG&E, the NRC inserted a secret revision to the plant’s license, which changed both the scientific calculations for assessing earthquake risks and retroactively declaring that the reactors were strong enough to withstand far greater seismic activity.

“At Diablo, it is now clear that these outdated 1960s-era reactors are not built to withstand the earthquake risks that surround the plant,” said Damon Moglen of Friends of the Earth.  “But instead of making them address these safety issues, the NRC worked with  PG&E to change the rules. It’s a scandal of the first order, and frankly very scary.”

A PG&E report released last month revealed that a newly discovered fault, located just 650 yards from the plant, is twice as long as the utility had maintained since 2011. The report also acknowledged one of Michael Peck’s most troubling concerns; that the new fault is connected to two others and together the three are capable of producing much stronger shaking than the plant was designed and licensed to withstand.

In the aftermath of the Fukushima nuclear disaster, a 2011 NRC study indicated that Diablo Canyon is the nuclear power plant in the U.S. most likely to fail in response to an earthquake larger than it was designed to withstand.

LOS ANGELES (AP) — The Nuclear Regulatory Commission on Wednesday rejected a senior federal expert's recommendation to shut down California's last operating nuclear power plant until the agency can determine whether its twin reactors can withstand powerful shaking from nearby earthquake faults.

In a decision written by Executive Director for Operations Mark Satorius, the agency concluded there is no immediate or significant safety concern at the Diablo Canyon plant, which sits on a seaside bluff midway between Los Angeles and San Francisco...

In the wake of a 6.0 magnitude earthquake near Napa, a shocking new report from a federal nuclear safety official raises the prospect that PG&E's Diablo Canyon nuclear power plant could face catastrophic failure when the next big earthquake hits, and recommends that it be shut down.1

The report,2 which was authored by Diablo Canyon's former lead on-site inspector, flatly refutes PG&E's claim that the plant's two nuclear reactors can withstand an earthquake like the earthquake that shook northern California just a few weeks ago.

Incredibly, the Nuclear Regulatory Commission is trusting PG&E's internal assessment of the danger of continuing to run the plant, despite the clear conflict of interest. With half a million people living within 50 miles of this disaster waiting to happen, the plant needs to be shut down now.

The engineers who designed the coastal nuclear plant at Fukushima believed it could withstand any disaster imaginable before a massive earthquake and tsunami struck in 2011 and caused a major catastrophe.

Here in California, sitting on the same earthquake prone Pacific Rim “ring of fire,” PG&E's engineers similarly claim that the Diablo Canyon nuclear plant can withstand any anticipated earthquake. But the plant was built long before a major fault line was discovered in 2008 -- just a few hundred yards offshore from the coastal nuclear plant.

The plant also sits nearby the Los Osos, Hosgri, and San Andreas Faults, a confluence of seismic features with dramatic potential activity that could overcome the plant’s outdated and inadequate safety design features.3 The fact is that no utility would choose to build and operate a nuclear facility at the current site knowing that it is surrounded by major fault lines.

The Nuclear Regulatory Commission has the power to revoke PG&E’s license to operate the Diablo Canyon nuclear power plant -- and that's exactly what it needs to do.

Diablo Canyon: NRC Insider’s Dissent - All Things Nuclear

...Dr. Peck found two kinds of problems:

(1) PG&E had not completely evaluated whether ground motion from an earthquake along the Shoreline Fault could damage vital plant components, and

(2) the evaluations PG&E had performed of other related issues used methods and assumptions that were unacceptable to the NRC.

Dr. Peck’s findings led him to conclude that the homework required for Diablo Canyon to continue operating safely had not been completed satisfactorily and therefore neither the company nor the NRC had adequate legal basis for the plant’s operation. He filed reports via two internal NRC processes—the non-concurrence and differing professional opinion (DPO) processes—to register his convictions and compel the agency to address them. The NRC is still assessing his latter DPO report, the one obtained and posted by FOE.

Peck Was Right

There is little doubt that Dr. Peck’s findings are correct. UCS obtained internal NRC emails and memos in January 2014 in response to our Freedom of Information Act request. These documents relate to the NRC’s review of a license amendment request (LAR) submitted by Diablo Canyon in October 2011. The company sought the NRC’s approval for its handling of the Shoreline Fault...

Dr. Peck’s findings are irrefutable and his conclusion consistent with nearly four decades of precedents. 

What is not clear is why Diablo Canyon continues to operate with inadequately evaluated protection against known earthquake hazards. The NRC’s job is to establish and then enforce safety regulations to protect public health. It is simply not getting that job done at Diablo Canyon.

As aftershocks of the 6.0 Napa earthquake that occurred Sunday in California continued, the Associated Press this week revealed a secret government report pointing to major earthquake vulnerabilities at the Diablo Canyon nuclear plants which are a little more than 200 miles away and sitting amid a webwork of earthquake faults.

It’s apparent to any visitor to the stretch of California where the two Diablo Canyon plants are sited that it is geologically hot. A major tourist feature of the area: hot spas.  “Welcome to the Avila Hot Springs,” declares the website of one, noting how “historic Avila Hot Springs” was “discovered in 1907 by at the time unlucky oil drillers and established” as a “popular visitor-serving natural artesian mineral hot springs.”

Nevertheless, Pacific Gas & Electric had no problem in 1965 picking the area along the California coast, north of Avila Beach, as a location for two nuclear plants.

It was known that the San Andreas Fault was inland 45 miles away. Then, in 1971, with construction underway, oil company geologists discovered another earthquake fault, the Hosgri Fault, just three miles out in the Pacific from the plant site and linked to the San Andreas Fault.

In 2008 yet another fault was discovered, the Shoreline Fault—but 650 yards from the Diablo Canyon plants.

The Shoreline Fault, and concerns about the vulnerability of nuclear plants to earthquakes in the wake of the 2011 Fukushima Daiichi disaster, are integral to a 42-page report written by Dr. Michael Peck, for five years the lead inspector on-site for the U.S. Nuclear Regulatory Commission at Diablo Canyon.

Peck’s report was obtained by the Associated Press, which has done excellent journalism in recent years investigating the dangers of nuclear power, and the AP issued a story Monday on the report.

In the report Peck writes: “The new seismic information resulted in a condition outside of the bounds of the existing Diablo Canyon design basis and safety analysis. Continued reactor operation outside the bounds of the NRC approved safety analyses challenges the presumption of nuclear safety...”

Mothers for Peace Spokeswoman Linda Seeley explains the many risks posed to California by the continued operation of PG&E's aged two-unit Diablo Canyon nuclear plant near San Luis Obispo, and why, like San Onofre was recently, it should be shutdown permanently - NOW.
This is another in the 'Preview Interview' series from the forthcoming EON documentary SHUTDOWN: The Case of San Onofre - "The Nuclear Free California Movement Rides Again."
The facility operated with some emergency systems disabled for nearly 18 months! Independent journalist Leuren Moret, a trained geophysicist who authored a 2004 Japan Times article predicting that an earthquake would lead to nuclear disaster in Japan, said it's "crazy" to allow Diablo Canyon to continue operating in the seismically active region, which is at the edge of the same tectonic plate that caused the Japan earthquake.
2011~Concerns about the seismic safety at the nuclear power plant were raised during a hearing of the California Legislature's Utilities and Commerce Committee. They were also raised in a letter sent to nuclear regulators by the state's U.S. senators.

"Roughly 424,000 live within 50 miles of the Diablo Canyon and 7.4 million live within 50 miles of the San Onofre Nuclear Generating Station," senators Barbara Boxer and Dianne Feinstein wrote in the letter to the U.S. Nuclear Regulatory Commission.

On Wednesday, a special task force assigned by the Nuclear Regulatory Commission released its findings about the preparedness of American nuclear plants, the NRC's role and whether the agency should make additional improvements to its regulatory systems. The task force was formed in response to the Fukushima disaster in Japan. After four months of study, the group announced twelve recommendations including the call to strengthen oversight of plant safety. According to one California legislator, a place that might benefit from that suggestion is a small town in his district with a potentially big problem.
